Thai SEC Files Criminal Charges Against OKX for Operating Without a License
Thailand's Securities and Exchange Commission (SEC) has taken a significant step by filing a criminal complaint against the cryptocurrency exchange OKX.
The complaint alleges that OKX, operated by Aux Cayes Fintech Co. Ltd., has been unlawfully providing digital asset exchange services to Thai users since October 15, 2021.
According to the SEC, the exchange charged transaction fees and promoted its services without the necessary regulatory approvals, potentially leading to criminal penalties.
The case will be investigated by the Economic Crime Suppression Division, bringing to light the serious nature of the alleged offenses.
In addition to OKX, nine individuals associated with promoting the unlicensed platform on social media have also been implicated.
Moreover, the SEC has highlighted OKX's failure to implement adequate know-your-customer (KYC) and anti-money laundering (AML) procedures, which may have exposed Thai investors to financial risks.
If convicted, both OKX and the individuals involved could face prison sentences ranging from two to five years, alongside hefty fines.
This enforcement action is part of Thailand's broader effort to tighten control over digital asset platforms, with past actions against other exchanges like Binance and Bybit.
Globally, OKX has also faced scrutiny, having settled a substantial $504 million case with U.S. regulators for operating without authorization.
As regulatory challenges mount, including the recent engagement of former Governor Andrew Cuomo for legal advice, OKX is positioned at a critical crossroads in the evolving crypto landscape.
